1. The service
Mercura Scout monitors public tender listings in Texas, sends you SMS alerts when a listing matches your profile, and produces a pre-filled bid pack on your reply. You are responsible for submitting your bid and for the accuracy of any information you provide.
2. Your account
You must give us accurate information when signing up and keep it up to date. You are responsible for the activity on your account and for keeping your phone and email access secure.
3. Subscription and billing
- Subscriptions are charged monthly in advance.
- The founding member rate ($99/month) is locked in for as long as your subscription stays active without interruption.
- You can cancel at any time; cancellation takes effect at the end of the current billing month.
- Fees are non-refundable except where required by law.
4. Bid packs and HASP documents
Bid packs are a tool to help you respond faster. You are solely responsible for reviewing each pack before submitting and for confirming that all HASP and compliance documents are current and accurate for the specific tender.
5. No guarantee of work
We do not guarantee that you will be matched with tenders, that you will win any tender, or that listings will be accurate or complete.
6. Acceptable use
Don't use Scout to break the law, infringe rights, send unsolicited communications, or misrepresent yourself to buyers. We may suspend or terminate accounts that do.
7. Intellectual property
Scout, the Mercura name and logo, the website and the bid pack templates are owned by Mercura Scout. You keep ownership of the business data you upload.
8. Disclaimer
The service is provided "as is". To the maximum extent allowed by law we disclaim all warranties, express or implied.
9. Limitation of liability
To the maximum extent allowed by law, our total liability to you for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim arose.
10. Governing law
These terms are governed by the laws of Texas, USA. Any dispute will be resolved in the state or federal courts located in Texas.
11. Changes
We may update these terms. Material changes will be notified by email or SMS at least 14 days before they take effect.
